To assist the High Qualification Commission of Judges of Ukraine in determining whether a judge (or candidate for the position of judge) meets the criteria of professional ethics and integrity for the purposes of qualification evaluation, a Public Integrity Council shall be formed.
The Public Integrity Council shall consist of twenty members.
Members of the Public Integrity Council shall be appointed by the assembly of representatives of public associations for a term of two years and may be reappointed.
Members of the Public Integrity Council may include representatives of human rights NGOs, legal scholars, lawyers, and journalists who are recognized experts in their professional fields, have a high professional reputation, and meet the criteria of political neutrality and integrity.
The following persons cannot be members of the Public Integrity Council:
- Persons declared legally incapable or with limited legal capacity by a court;
- Persons with a criminal record that has not been expunged or annulled according to the law;
- Persons who have received an administrative penalty for a corruption-related offense within the past year;
- Persons who have worked or served within the past five years in the Prosecutor’s Office, the Ministry of Internal Affairs of Ukraine, the National Police, the State Bureau of Investigation, other law enforcement agencies, the Tax Police, the Security Service of Ukraine, customs authorities, the National Anti-Corruption Bureau, the Bureau of Economic Security, or the National Agency for the Prevention of Corruption;
- Persons who have been in public service within the past five years;
- Persons who are currently judges or retired judges.
Public organizations or associations that have, for at least the past two years prior to the date of the assembly, been engaged in activities related to combating corruption, protecting human rights, and supporting institutional reforms (including implementing relevant projects in these fields) may participate in the assembly of representatives. Public organizations or associations are not eligible to participate in the assembly if they have conducted or are conducting activities funded through international technical assistance provided by government authorities, local self-government bodies, institutions, organizations, or enterprises of a country recognized by the Verkhovna Rada of Ukraine as an aggressor state.
Within fifteen days from the date of publication of the announcement of convening an assembly of representatives of public associations (by 08 July 2025 inclusive), public associations shall submit:
- A free-form application signed by the head of the public associations, indicating the person authorized to represent the association at the assembly;
- A copy of the association’s charter and an extract from the Unified State Register of Legal Entities and Individual Entrepreneurs;
- Copies of reports on the implementation of projects involving international technical assistance (if available);
- A recommendation letter from an international organization with an impeccable reputation confirming successful cooperation experience, or from an implementing partner of a technical assistance project;
- Copies of financial audit reports for at least two completed projects with the involvement of international technical assistance or a copy of the report on the audit of the association’s overall activity;
- A biography of the association’s representative;
- A biography of the candidate (candidates) to the Public Integrity Council nominated by the public association, as well as a motivation letter of the candidate and a declaration of the person authorised to perform the functions of the state or local self-government submitted by the candidate (signed by him/her).
The High Qualification Commission of Judges of Ukraine shall decide on the compliance of a public association with the requirements for participation in the assembly of representatives of public associations within ten days from the date of receipt of the application and the documents attached thereto.
The list of public associations that meet the requirements for participation in the assembly of representatives of public associations, copies of the documents submitted by them, as well as the list of candidates to the Public Integrity Council will be published on the official website of the High Qualification Commission of Judges of Ukraine.
A notification of the time and place of the assembly of public associations representatives will be posted on the official website of the High Qualification Commission of Judges of Ukraine no later than ten days before the assembly takes place.
